1. Acceptance of Terms

By accessing and using the Thinkexponent website and services, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Provision of Services

Thinkexponent is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the services which Thinkexponent provides may change from time to time without prior notice to you.

3. Use of the Services

You agree to use the services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. You agree not to access (or attempt to access) any of the services by any means other than through the interface that is provided by Thinkexponent.

4. Payment and Retainers

All retainers and project fees are strictly non-refundable once work has commenced. We bill on a structured schedule as agreed upon in your specific Master Services Agreement (MSA).

5. Limitation of Liability

You expressly understand and agree that Thinkexponent, its subsidiaries and affiliates, and its licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability.

6. Changes to the Terms

We may modify these Terms from time to time to reflect changes in market conditions affecting our business, changes in our business, changes in payment methods, changes in technology, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
